CHOICE OF LAW AND FORUM
To the fullest extent permitted by law, these Terms and their subject matter shall be construed in accordance with and governed by the laws of the state of Ohio.
Any dispute arising out of these Terms, the use of this site, and/or the purchase or use of our products shall be initiated through arbitration as described in Section 13 above. However, you consent to litigate any dispute concerning the language of the arbitration provision in Section 13 in a state or federal court located in Hamilton County, Ohio.
NO WAIVER
If we fail to insist that you perform any obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived such rights and will not mean that you do not have to comply with your obligations. If we do waive a failure or breach by you, we will only do so in writing and that will not mean that we automatically waive any future failure of breach by you.
